Monthly Business Meeting

Executive session held 6:00 PM - 6:52 PM — litigation matters

The Halifax Township Board of Supervisors held its monthly business meeting on June 14, 2010, following an executive session on litigation matters. All five supervisors were present: Chairman Kenneth Bechtel, Linda Stopfel, Carol Eppley, Ken Hoover, and Gary Shultz. The nearly three-hour meeting covered road paving, nuisance enforcement, park property debates, and several administrative matters, with Carol Eppley and Linda Stopfel departing before the final votes of the evening.

  • Annual paving project advertised: The board unanimously approved advertising for bids to pave segments of Hoffman Road, Ridge Road, Kieffer Road, and Baddorf Road, with an estimated cost of $145,000–$156,000 against approximately $183,000 available in liquid fuel funds.

  • Patriot Energy electric contract ratified: A 2-year contract locking in an electric generation rate of $0.0822/kWh was ratified unanimously.

  • Nuisance enforcement escalated at 2859-A Mountain Road: After six months of inactivity following a December 2009 notice, the board directed a second violation notice with photographs and a firm compliance deadline be sent to David Scheidler.

  • Nuisance closed at 11 Rutter Road: No enforcement action was taken against Clifford and Katherine Harn after all vehicles on the property were confirmed to be licensed and operable, and overgrown vegetation had been addressed.

  • Park barn condition presented: Gary Shultz showed photographs of severely deteriorated supporting beams, a collapsed second floor, and a crumbling foundation. Restoration estimates range from $125,000 to $350,000, and the lower level cannot be used due to its floodplain location. No decision was made; the board agreed to invite Carl Dickson to present his assessment.

  • DCNR farming waiver to be pursued: After Carol Eppley and Linda Stopfel departed, the remaining three supervisors voted 3–0 to have Solicitor Bruce Warshawsky draft a formal waiver request to DCNR to continue farming the park property. Linda Stopfel had expressed concern the effort could jeopardize future grant funding before leaving; Warshawsky indicated it could be drafted without harming grant prospects.

  • Outstanding fees sent to collections: Four accounts totaling $582.45 in unpaid solicitor and engineering fees were turned over to JP Harris for collection at a 25% contingency fee, after prior invoices and letters from two solicitors failed to produce payment.

  • Manning lease arrears: The former park tenants owe $1,769.49; the board agreed to a repayment plan of $250/month starting in June with the balance due by end of December 2010.

Donna Rode — Extended gratitude to the new board for transparency efforts and resolution of longstanding issues. Expressed concern that Secretary Ferguson had not been assigned grant writing duties despite being hired for that role, and asked the board to assign her to apply for grants.
Kenneth Masser — Inquired as to when he would receive a response to questions posed at last month's meeting regarding run-off from the Lenker Estates Development. Chairman Bechtel indicated the board would likely respond by next meeting.
Melinda Warfel — Reported that the Fire Department is still reviewing the dissolution clause in the fire service agreement to determine consistency with their 501c(3) tax status and by-laws. Noted the Fire Department's interest in transferring assets to another fire company upon dissolution. Solicitor Warshawsky expressed concern about language directing assets to a fire company with whom the Township has no formal agreement, given the Township's legal responsibility to provide fire services.

Heim/Kauffman Matter - Fuhrman Road Access

Solicitor Warshawsky reported that Ms. Kauffman granted Mr. Heim permission to use Fuhrman Road, but expressed concern about overlooking subdivision plan contingencies requiring installation of a road to serve Mr. Heim's property. Dale Shoop noted Mr. Heim planned to apply for a PennDOT driveway permit and, if denied, seek a Township waiver. The board decided not to intervene and allow Mr. Heim to pursue the matter with PennDOT.

ENGINEER REPORT

Pawnee Road Drainage - Baer Complaint

Tom Wilson reported that after reviewing the site on June 8, 2010 with Dale Shoop, it remained his position that the private pipe and drainage inlet are Mr. Baer's responsibility as they are on private property. Solicitor Warshawsky clarified that prior Township pipe replacement on private property in the subdivision was warranted by different circumstances involving rusted pipe within the Township's right-of-way. The board directed Secretary Ferguson to send Mr. Baer a summary letter of their position.
