Monthly Business Meeting
Executive session held April 25, 2016, 7:10 PM – 7:30 PM — Litigation
Summary
The Halifax Township Board of Supervisors held its monthly business meeting on May 9, 2016, with all five supervisors present: Chairman Kenneth Bechtel, Brad Bruner, Randy Paul, Scott McBurney, and Steve Schreffler. The nearly three-hour session was one of the more productive of the year, as the board adopted a batch of ordinances tied to the Township's sidewalk grant project, updated the employee handbook with two new policies, and launched the 2016 road paving season.
Three sidewalk-related ordinances adopted: The board unanimously approved a no parking ordinance to clear the construction corridor, a sidewalk maintenance ordinance with fines of $235–$300 for violations, and an intermunicipal agreement with neighboring municipalities — all connected to the Township's sidewalk grant project. PennDOT also approved a speed limit reduction from 40 mph to 35 mph in the project area.
2016 road paving bids authorized: With approximately $238,000 available after reserving $5,000 for line painting, the board voted to advertise for bids on paving Camp Hebron Road, Hill Drive, and Seiders Road, with bid opening set for the June 13 meeting.
Employee handbook updated with two new policies: The board formally adopted an overtime policy and a volunteer firefighter policy for the Township's employee handbook, completing work that had been discussed in prior executive sessions.
Lehman property stormwater dispute unresolved: Although a prior stormwater complaint was withdrawn at the District Justice level, Engineer Steve Roe calculated roughly 1,700 square feet of new impervious coverage on the Lehman property — exceeding what was represented to the Planning Commission when a waiver was granted. The property owner disputed adding any impervious coverage. The board directed an "as-built" survey with calculations to determine compliance.
Nuisance and signage enforcement letters authorized: The board voted to send warning letters regarding unlicensed vehicles on Pawnee Lane, unlicensed and uninspected vehicles parked in the alley near the Township building, and unauthorized signs placed in the Township right-of-way at Boyer Street.
Snowstorm reimbursement of approximately $10,000 expected: The Township anticipates receiving about $10,000 — representing 75% of costs — from the January 2016 snowstorm emergency response, after paperwork assembled by EMC Tim Neiter, Roadmaster Corey Stazewski, and Secretary Wendy Wentzel.
Pool insurance options explored: Resident Emily Hoffman asked whether the Township would add the Halifax Area Recreation Authority's swimming pool to its insurance. Scott McBurney estimated Township coverage at roughly $1,200 annually versus $6,000–$7,000 for standalone nonprofit coverage and agreed to research the options.
Fort Halifax festival reported as a success: Norma Shearer of the Friends of Fort Halifax reported that the recent festival drew approximately 1,300 people at its peak with more re-enactors than in past years, and thanked the Township for its support.

Meeting business
Secretary/Treasurer Report
Supervisors approved paid interim bills through May 9, 2016 (motion by Paul, second by Bruner, 5-0), unpaid bills as of May 9 (motion by Schreffler, second by McBurney, 5-0), and the April 11, 2016 meeting minutes (motion by Paul, second by Schreffler, 5-0). The financial report was placed on file for audit.
EMC Report
Supervisor Bruner reported that substantial paperwork was completed and submitted for the January snowstorm reimbursement, publicly thanking EMC Tim Neiter, Roadmaster Stazewski, and Secretary Wentzel for their efforts. Bruner anticipates reimbursement of approximately $10,000, representing 75% of the Township's costs for that snow event.
Planning Commission Recommendation
Chairperson Flo Mallonee reported no Planning Commission meeting was held in May. She noted DCNR remains an active player and has requested a meeting with Engineer Roe to discuss his comment letter; Roe stated a meeting would be scheduled for the following week.
Engineer Report
Engineer Roe provided an overview of his report dated May 2, 2016 covering services during April. No action was taken and the report was placed on record.
Solicitor Report
Solicitor Warshawsky reported the Dunkel School Road nuisance is slowly being abated. Fill from the Sheetz site is being moved to the Township site with secondary transfers to a Camp Hebron Road site near Corsnitz, with DEP and the Conservation District reviewing. The Druckenmiller stormwater property on Million Dollar Road is being sold, requiring new owners to follow the approved plan and execute a new O&M agreement. Chairman Bechtel raised Quail Commons, and Warshawsky confirmed a billing error will be corrected with the July 1st billing including the missed increment.
Roadmaster Report
Roadmaster Stazewski reported that an old nuisance of unregistered vehicles on Pawnee Lane has returned; supervisors voted 5-0 (motion by Bruner, second by Schreffler) to send a letter. He also noted trucks at a Maple Street address of previous concern were cleaning up the property, and that the Susquehanna River Trail had announced an event ending at Fort Halifax Park without notifying the Township—they will be required to complete proper forms.
Administrative
Solicitor Warshawsky read changes to the overtime definition for the Employee Handbook, which had been approved during a March executive session. Supervisors voted 5-0 (motion by McBurney, second by Bruner) to adopt the overtime policy as read.
Supervisors voted 5-0 to waive the reading of the Volunteer Firefighter Policy (motion by Bruner, second by Paul), then voted 5-0 (motion by McBurney, second by Schreffler) to adopt the policy for the Employee Handbook.
Supervisor McBurney reported no significant changes from prior year coverage. The annual premium dropped $2,001 due to lower Workers' Compensation costs. Discussion covered new equipment appraisals, loss-of-salary/fringe-benefit insurance (estimated $155 increase, deemed unnecessary but McBurney will research further), and alcohol on Township property (no coverage needed as alcohol is not sanctioned). McBurney will prepare a written document for next month's meeting.
Secretary Wentzel reported that the PSATS Pension Trust annual fee is $200 if paid electronically or $300 by manual check for five or fewer employees. Discussion covered probationary periods and whether to add retirement benefits to the Employee Handbook; the handbook question was deferred to executive session next month. For the Health Trust (100% employee-funded), the Board agreed there should be no probationary period.
Melinda Warfel reported that 60 letters were sent to landlords of Township tenants, with most larger landlords responding. The Liquid Fuels Audit with PennDOT is being rescheduled because the Township's outside auditor has not yet filed the Annual Financial Audit with DCED. Giant agreed to donate $50 in gift cards for Township cleanup day workers after receiving a letter on Township stationery.
Old Business
The Township received a letter from PennDOT approving a speed limit reduction from 40 mph to 35 mph in connection with the sidewalk grant project.
Supervisors voted 5-0 to waive the reading of the No Parking Ordinance (motion by Schreffler, second by Bruner), then voted 5-0 (motion by Schreffler, second by McBurney) to adopt the No Parking Ordinance for the sidewalk project.
Supervisors voted 5-0 to waive the reading of the Intermunicipal Agreement (motion by Bruner, second by Paul), then voted 5-0 (motion by Bruner, second by Schreffler) to adopt the agreement.
Supervisors voted 5-0 to waive the reading (motion by Schreffler, second by McBurney), then voted 5-0 (motion by Bruner, second by Paul) to adopt the Sidewalk Maintenance Ordinance with additions: the number 6 in Section 2B, the number 18 in Section 3, and fee language of "not less than $235 but not more than $300" in Section 4.
Solicitor Warshawsky reported that DEP acknowledged receipt of his letter regarding Act 537.
The Township received multiple complaints about unlicensed and uninspected vehicles parked in the alley-way near the Township building. Supervisors voted 5-0 (motion by McBurney, second by Schreffler) to send a pre-nuisance letter to the parcel owner.
Solicitor Warshawsky noted the prior stormwater complaint was withdrawn at the District Justice office. However, Engineer Roe calculated approximately 1,700 square feet of new impervious coverage (building and surrounding stone) exceeding what was represented to the Planning Commission, which had granted a waiver based on no additional impervious coverage. Roe recommended modifying the existing stormwater plan since impervious coverage exceeds an additional 700 square feet. Warshawsky suggested an "As Built" with calculations; Chairman Bechtel noted that if Mr. Lehman can prove the depth exceeds specs by 18 inches, he may meet stormwater requirements, and this can be submitted before the next meeting.
New Business
Roadmaster Stazewski identified Camp Hebron Road, Hill Drive, and Seiders Road for paving, with approximately $238,000 available after reserving $5,000 for line painting. Supervisors voted 5-0 (motion by Schreffler, second by Bruner) to advertise for bids on each individual road, with bid opening at the June 13, 2016 meeting.
No action was taken on the DCED Urban County letter since the Township chose not to opt out.
The Township received a report that someone was seen taking firewood from the Fort Halifax Park driveway without permission. Frank Wilmarth stated an elm tree was taken down on the Friends of Fort Halifax parcel and wood was being removed, but no one from their group had taken wood from Fort Halifax.
The Township received complaints about signs placed at the bottom of Boyer Street in the Township right-of-way without Board permission. Supervisors voted 5-0 (motion by McBurney, second by Bruner) to send a letter to the landlord addressing the tenant's placement of the signs.
Adjournment
Supervisor Bruner moved and Supervisor McBurney seconded to adjourn the meeting at 9:52 p.m. Motion carried 5-0.
